| 中文概述 Chinese Description | 當代智慧財產權蓬勃發展，憲法不僅保障之財產權，亦肯定「文化基本權」和以原住民族為主之「多元文化主義」，從而催生「文化資產保存法」、「原住民族基本法」及「原住民族傳統智慧創作保護條例」等，上開法律強調公共利益、集體性質、既有狀態，有別於資本主義框架下強調個人權益與新穎特性之智慧財產權，兩者難以避地發生競合、聯動等法律爭議。課程內容規劃涉及各類傳統智慧創作之法制、與著作權之比較研究、國際相關案例分析、博物館授權、文化資產、地方創生、地理標示、以及伴隨新興科技所引發之議題。 | |||
| 英文概述 English Description | Amid the flourishing development of contemporary intellectual property rights, in addition to the constitutionally guaranteed right to property, Taiwan has further recognized cultural fundamental rights and embraced multiculturalism, particularly with respect to indigenous peoples. In this context, statutes such as the Cultural Heritage Preservation Act, the Indigenous Peoples Basic Law, and the Protection Act for the Traditional Intellectual Creations of Indigenous Peoples have been enacted. The course is designed to address these matters through comparative studies with copyright law, analyses of relevant international case law, issues surrounding museum licensing, cultural heritage protection, community revitalization, geographical indications, and disputes arising from emerging technologies. | |||
